A Delta State High Court sitting in Orerokpe has issued an interim injunction restraining the Inspector General of Police, Olukayode Egbetokun, the Nigeria Police Force, and the Delta State Police Command from resuming the enforcement of the tinted glass permit policy across the country.
The court also barred the police from stopping, harassing, arresting, detaining, or extorting motorists and other citizens on the basis of the policy.
Justice Joe Egwu granted the orders on Wednesday in an ex-parte application filed by a Nigerian, Israel Joe, in suit number HOR/FHR/M.3/2025.
By the ruling, the planned resumption of the tinted glass permit enforcement scheduled by the police for January 2, 2026, has been halted, pending the hearing and determination of the substantive suit.
In addition, the court restrained the Inspector General of Police, the Nigeria Police Force, and their officers, agents, and contractors from continuing to use the Parkway Projects Account, described as a private contractor’s account, to conduct any government business while the suit is pending.
Delivering the ruling, Justice Egwu ordered “an interim injunction restraining the 1st and 2nd respondents, their officers, men, agents, privies, and/or contractors from implementing, enforcing, or further implementing the Tinted Glass Permit Policy pending the hearing and determination of the substantive application.”
The judge further ordered that the police must not “stop, harass, arrest, detain or extort citizens or motorists under the guise of enforcing the Tinted Glass Permit Policy” during the pendency of the case.
The court also approved substituted service of court processes on the Inspector General of Police and the Nigeria Police Force through the Delta State Commissioner of Police at the state command headquarters in Asaba, with such service deemed proper.
The applicant, Israel Joe, was represented by Kunle Edun, SAN, alongside other legal practitioners.
The interim orders will remain in force until the substantive application is heard and determined by the court.
